1. Acceptance of Terms
By accessing our website, making a reservation, or using any services offered by H2O Adventures / Aventures H2O inc. (the "Company"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.
2. Services
H2O Adventures offers the following services at the Lachine Canal Nautical Centre (2985B rue St-Patrick, Montreal, QC):
- Rental of electric boats, kayaks, stand-up paddleboards (SUPs), pedal boats, canoes and voyageur canoes
- Guided tours and instructional courses
- Individual and group activity packages
- Season memberships and gift certificates
3. Reservations and Payment
All prices are in Canadian dollars and include applicable taxes and a 5% non-refundable transaction fee. Payment is required at the time of booking.
4. Cancellation and Refund Policy
Please refer to our Refund Policy, available on our website, for full details. In general:
- Cancellations made with sufficient advance notice (min. 24 hours) may be eligible for a refund, minus the 5% non-refundable transaction fee.
- No-shows and last-minute cancellations may not be eligible for a refund.
- H2O Adventures reserves the right to cancel or reschedule activities due to unsafe weather conditions or other circumstances beyond our control. In such cases, a full refund or rescheduling option will be offered.
5. Safety and Participant Responsibilities
The safety of our participants is our top priority. By using our services, you agree to:
- Follow all safety instructions provided by H2O Adventures staff.
- Wear all required safety equipment, including personal flotation devices (PFDs), at all times on the water.
- Not operate any rental equipment under the influence of alcohol or drugs.
- Supervise any minors in your group at all times.
- Report any damage to equipment or safety concerns to staff immediately.
- Remain within the designated areas of the Lachine Canal as indicated by staff.
6. Limitation of Liability and Waiver
Participation in water-based activities involves inherent risks. By using our services, you acknowledge and accept these risks. H2O Adventures, its employees, and affiliates shall not be liable for any injury, loss, or damage arising from your use of our services, except where prohibited by applicable law.
Participants may be required to sign a separate liability waiver prior to using certain services. Minors must have a waiver signed by a parent or legal guardian.
7. Equipment Use and Damage
Rental equipment must be used responsibly and in accordance with staff instructions. You are responsible for any damage to equipment caused by misuse or negligence during your rental period. H2O Adventures reserves the right to charge for repair or replacement costs.
8. Privacy
We collect and use personal information provided during booking for the purpose of delivering our services. We do not sell your personal information to third parties. By using our services, you consent to this use of your information in accordance with applicable Canadian privacy legislation.
9. Governing Law
These Terms and Conditions are governed by the laws of the Province of Quebec and the applicable laws of Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts of Quebec.
10. Changes to Terms
H2O Adventures reserves the right to update these Terms and Conditions at any time. Updated terms will be posted on our website. Continued use of our services after changes are posted constitutes your acceptance of the revised terms.
